Legal Distinction Guide

What Is a Statutory Declaration — and How Is It Different from an Affidavit?

A statutory declaration is a formal written statement in which a person declares that certain facts are true — made solemnly, without taking an oath.

This is the key distinction from an affidavit. An affidavit is sworn under oath. A statutory declaration is affirmed solemnly — the declarant commits to the truth of what they are stating, but the process does not involve the formal swearing of an oath before a higher authority.

In practice, the difference matters because some institutions — particularly in commercial, banking, and administrative settings — specifically request a statutory declaration rather than an affidavit. Others use the terms interchangeably. If you are unsure which your institution requires, we can confirm this for you before any drafting begins.

In Qatar, statutory declarations are prepared through MOJ-licensed lawyers who witness the signature, verify the declarant's identity, and formally attest that the declaration was signed in their presence. The lawyer's stamp and registration number appear on the final document, giving it the official standing that receiving institutions require.

What Is a Statutory Declaration Qatar lawyer witnessing explanation

Statutory Declaration

A solemn affirmation of facts — no oath required. Witnessed by a MOJ-licensed lawyer. Most commonly used for administrative, commercial, banking, and overseas submissions.

Affidavit

A sworn statement of facts — made under oath. Used for legal, judicial, and personal declarations. Carries the added gravity of a formal oath before a legal professional.

What Every Valid Statutory Declaration Must Contain

A document that is missing any of these four elements will either be rejected outright or returned for correction. Many clients come to us after exactly this happens with a self-prepared or template-based draft.

  1. Full Declarant Identity

The full legal name, nationality, passport or ID number, occupation, and address of the person making the declaration must appear at the start. Partial identification — name only, or name and passport only — is a common reason for institutional rejection.

  2. Numbered Paragraphs of Facts

Each fact being declared must be stated separately in numbered paragraphs. Facts should be specific and verifiable — including relevant dates, document numbers, amounts, names of parties, and locations. Narrative-style writing or general statements weaken the declaration's credibility and can lead to challenge or rejection.

  3. Solemn Affirmation Clause

Unlike an affidavit's jurat clause ("Sworn before me..."), a statutory declaration uses a solemn declaration clause — typically reading: "I solemnly and sincerely declare that the above is true, and I make this solemn declaration conscientiously believing the same to be true." Without this clause, the document is not legally a statutory declaration.

  4. Lawyer Witness Attestation Block

The witnessing lawyer's full name, MOJ registration number, stamp, and signature must appear at the end of the document — along with the date and location where the declaration was signed. This block is what institutions verify when assessing the document's authenticity.

Our Compliance Check: We check all four elements in every declaration before it is signed. If your draft is missing any, we correct it before the witnessing session.

Is a Statutory Declaration the Right Document for You?

Sometimes clients arrive requesting a statutory declaration when what they actually need is something different. Submitting the wrong document type creates delays — it gets rejected and you need to start again.

Here is a practical guide to the situations where you should request a different document instead:

If the institution is asking for...

A sworn statement or affidavit (specifically by name)

→ Affidavit Notarization — not a statutory declaration. The oath vs affirmation distinction matters to some institutions, particularly courts and embassies.

If the institution is asking for...

Authority to act on someone else's behalf (sign contracts, sell property, manage affairs)

→ Power of Attorney — not a declaration. A declaration confirms facts; a POA grants legal authority to another person.

If the institution is asking for...

A verified copy of an existing document (passport, degree, ID)

→ {{TODO_LINK:certified-true-copy-qatar}} — not a declaration. You need the original document certified as a true copy, not a statement about the document.

If the institution is asking for...

A witnessed signature on a contract or agreement

→ {{TODO_LINK:signature-witnessing-qatar}} — not a declaration. The document already exists; it just needs a witnessed signature, not a new written declaration.

If the institution is asking for...

A statement given in front of a court or judge

→ Sworn Statement / Judicial Declaration — handled by the court, not a notary. Contact the relevant court authority in Qatar.

Not sure? Tell us the name of the institution requesting the document and what it will be used for — we will confirm the correct document type before your visit.

How We Handle Statutory Declarations at Notary Qatar

  1. Confirm Purpose & Type

We first confirm that a statutory declaration is what your situation requires. If you need an affidavit, POA, certified copy, or witnessed signature instead, we tell you immediately — before any drafting begins. This step saves time and prevents wasted visits.

  2. Draft or Review

If you have a draft, we review it against the four validity elements. If you need a declaration drafted from scratch, we prepare it from your description — correctly formatted, with numbered paragraphs, full declarant details, and the correct solemn affirmation clause.

  3. Identity Verification

Before witnessing the declaration, our MOJ-licensed lawyer verifies your identity using your original passport and Qatar ID. This is a mandatory legal requirement for the declaration to be valid — it cannot be bypassed or done remotely.

  1. Sign & Witness in Person

You sign the declaration in the physical presence of our MOJ-licensed lawyer. The lawyer witnesses the signing, applies their official stamp, adds their MOJ registration number, and signs the attestation block. The statutory declaration is now complete and legally valid.

  2. Collection & Next Steps

Your witnessed statutory declaration is ready. For declarations going abroad, we explain the MOFA attestation and embassy authentication steps required. We do not send you away without clarity on what happens next.

FREQUENTLY ASKED QUESTIONS

Statutory Declaration Qatar — Frequently Asked Questions

A statutory declaration in Qatar is a formal written statement in which a person solemnly declares that certain facts are true, without taking an oath. It is signed in the physical presence of a MOJ-licensed lawyer who witnesses the signature, verifies the declarant's identity, and applies their official stamp and registration number to the document. The completed declaration is then accepted by banks, employers, embassies, overseas authorities, and government bodies.
The key difference is oath vs solemn affirmation. An affidavit is sworn under oath — the declarant formally commits to the truth before a legal professional using a sworn oath. A statutory declaration uses a solemn affirmation — a formal, serious commitment to the truth without an oath. In Qatar, many institutions use both terms interchangeably, but some — particularly courts or embassies — specifically require one or the other. Always confirm with the receiving institution before drafting.
Yes. If you do not have a draft, we prepare the full declaration based on your description of the facts. We structure it with correct numbered paragraphs, full declarant details, the solemn affirmation clause, and the lawyer attestation block — so it is ready for signing and witnessing without needing corrections.
Yes. You must sign the declaration in the physical presence of our MOJ-licensed lawyer. Identity verification using your original passport and Qatar ID is a mandatory part of the witnessing process. The declaration cannot be pre-signed and brought in for stamping — the signing must occur in the lawyer's presence.
Every valid statutory declaration must include: (1) Full declarant identity — complete name, nationality, passport or ID number, occupation, and address. (2) Numbered paragraphs of specific facts. (3) The solemn affirmation clause — "I solemnly and sincerely declare that the above is true, and I make this solemn declaration conscientiously believing the same to be true." (4) The lawyer witness attestation block — name, MOJ registration number, stamp, signature, date, and location.
A Declaration of Name Variation is a statutory declaration confirming that two or more different name versions appearing on different official documents belong to the same person. This is very common for Indian expats (PAN card vs passport spelling), Pakistani expats (CNIC vs passport), Nepali and Bangladeshi workers (home country ID vs Qatar work permit), and any expat whose name was transliterated differently across different countries' document systems. Banks, property registration offices, and consulates regularly request this declaration.
For a standard declaration where the draft is ready and all identification is available, the process is typically completed within the same session — usually under 30 minutes. If drafting support is needed, the declaration can usually be prepared within the same or following day depending on the complexity of the facts. Same-day urgent witnessing is available.
Our declarations are witnessed by a Qatar MOJ-licensed lawyer and are recognised by all Qatar-based embassies and MOFA. For submissions going abroad, the typical chain is: witnessed statutory declaration → MOFA attestation → embassy authentication. We advise on the exact chain needed for your specific nationality and purpose at the time of collection.
Yes. Corporate statutory declarations are commonly used for banking KYC compliance, beneficial ownership disclosures, tender bids, commercial contracts, and regulatory filings. The authorised signatory of the company must be present for identity verification and signing, and may need to bring a board resolution or company registration document depending on the nature of the declaration.
No. A notarized letter is typically a personal or business letter that a notary has stamped to verify the signature. A statutory declaration is a specifically formatted legal document with numbered facts, a solemn affirmation clause, and a formal lawyer witness attestation block. Many institutions that request a statutory declaration will not accept a notarized letter as a substitute.
Contact us with the rejection reason. In most cases, rejection happens because of missing information, the wrong document type was submitted, or additional attestation (MOFA or embassy) was required. We identify the specific issue and advise on whether a revised declaration, a different document type, or additional authentication steps are needed to resolve it.
Yes. Same-day witnessing is available for standard statutory declarations where a complete draft is ready and all required identification is present. For urgent cases — embassy appointments, visa deadlines, or time-sensitive banking submissions — WhatsApp us before visiting so we can prioritise your case appropriately.
